There is new legislation in Utah that you probably haven’t heard about, but if you vape you’ve likely felt the effects. Have you gone to your favorite vape shop’s website, ready to purchase new liquid
and realized that they no longer offer an online shop? Or tried to check out at a web-based store with a new mod, only to be told that they no longer ship to Utah?
This is due to a new Utah law – the E-Cigarette Licensing Act of 2015. The law states that as of July 1, 2016 Utah residents are no longer allowed to purchase any vape products online. To comply with the law, most shops in Utah have completely shut down the ability to purchase products online. Many vape shops across the country will no longer ship their products to the state.
This is a harmful step, not only for the small businesses that dominate the vaping industry, but also for the millions of people who vape. Without online sales, it becomes a lot more difficult to get your products out there. Without the ability to buy online, more people aren’t going to be able to get the juices and products they need to help get them off cigarettes for good.
Even living in Utah, many vapers simply don’t know about this new legislation. There are shops around the country that are still shipping to Utah, because they haven’t heard about the new laws.
As a consumer, you should know that the law states that sales must be made through a “face-to-face exchange”, excluding sales through a vending machine, self-service display, or even online.
The whole thing gets even more confusing when you dig in a little. The Utah Department of Health has sent out memos and statements saying that they’re not actually going to enforce this law yet. In fact, there’s no clear time as to when it will be enforced. On top of this, they recently revised a number of laws regarding vaping mostly aimed at shops and manufacturers.
The reason? The new FDA regulations. There are so many new laws and regulations being pushed by the FDA when it comes to vaping that it can get a little confusing. So, Utah is holding back a little on their own laws to make sure that everything is in compliance with the federal regulations.
Many shops want to err on the side of caution, which means limiting online sales. If you find that you can’t get your favorite juices online anymore, don’t give up!
